The quick progress of artificial intelligence technologies has raised legitimate concerns regarding their negative consequences, related to potential impacts on the exercise of human rights and, particularly, the risk of discrimination against historically vulnerable groups.<\/p>

Given the potentially irreparable consequences of implementing artificial intelligence techniques can have without human rights considerations \u2014particularly in a region marked by high levels of inequality and the absence of adequate guarantees for the protection of rights\u2014 it is essential to analyze the policies and initiatives developed at a regional level, identifying areas for improvement in light of current international principles and good practices that respond more appropriately to the local context.<\/p>

To this end, we initially developed 4 case studies on different implementations of artificial intelligence in four Latin American countries.<\/p>

In Brazil, the researchers analyzed the use of Artificial Intelligence in the National Employment System, with the aim of facilitating the placement of unemployed professionals in the labor market. In Chile the investigation focused on the Child Alert System, which seeks to estimate and predict the level of risk to children and adolescents of suffering a violation of their rights in the future. In Colombia the researchers analyzed PretorIA, a project of the Colombian Constitutional Court whose goal is to make the process of selecting cases on judicial protection of fundamental rights more efficient. In Uruguay, the research focused on Coronavirus UY, a free mobile application made available by the Uruguayan Ministry of Public Health to manage the COVID-19 pandemic.<\/p>

In 2024, we conducted four additional studies on the use of AI as a tool for public policy. In Argentina, we analyzed the Chatbot Boti system, an automated assistant implemented by the Buenos Aires City Government to facilitate online self-management of procedures. In Colombia, we examined the Fiscal Watson case, where the IBM Watson AI system was implemented in the Office of the Attorney General. In Mexico, we studied the Early Action System for School Retention, an algorithm designed to predict the likelihood of students dropping out of secondary school in Guanajuato. In Paraguay, we reviewed the EmpleaPy Portal, a platform that uses algorithms to connect job seekers with employment opportunities.<\/p>

The case studies were developed in collaboration with research centers, human rights organizations and researchers: ADC (Argentina), Dejusticia and Fundaci\u00f3n Karisma (Colombia), MediaLab.UFRJ and Red LAVITS (Brazil), Tedic (Paraguay) Dina Yael (Uruguay), Mat\u00edas Valderrama (Chile), Paola Ricaurte and Jacobo N\u00e1jera (Mexico).<\/p>

Derechos Digitales is a Latin American, independent, non-profit organization, founded in 2005, whose main objective is the development, defense, and promotion of human rights in the digital environment.<\/p>

Since 2019, Derechos Digitales has been part of the Cyber \u200b\u200bPolicy Research Centers Network funded by the International Development Research Centre (IDRC), along with leading organizations on technology and public policy issues in the Global South.<\/p>

One of our goals as part of this network is to develop advocacy capacities in the regulation and implementation of new technologies based on artificial intelligence in Latin America.
